WALKER PARTICIPANT WAIVER
Each participant, and parent or guardian of youth participants, must agree to this Waiver for themselves and on behalf of any youth under 18 years of age, and/or pet walker that they are registering.
I hereby acknowledge my voluntary participation in the Meals on Wheels of Mercer County
Paws for a Cause Pet Walk (the “Walk”) at Rosedale Park may result in personal injury to me, any minor under my care, and/or my pet(s) “Pets”.
By participating in, attending, or observing the Event, I acknowledge and assume all risks and dangers that are incidental to, or in any way arise from, the Event including, without limitation, all risks and danger inherent in a canine-oriented event (e.g. dog bites, cat scratches, fights or altercations, falls, and contact with participants or spectators at the Event) and in the sport of walking.
I understand that walking at events are potentially hazardous activities, which could cause injury or death. I should not enter and walk in the Event unless I am medically able and properly trained to walk my pet, and by my signature, I certify that I am medically able to perform this event, and am in good health, and I am properly trained to walk my pet.
I agree to abide by any decision of an Event official relative to my ability to safely complete the Event.
I assume every risk associated with participating in the Event including, but not limited to: falls, contact with Event participants or volunteers or with vehicles or Pets, the effects of the weather, including high heat and/or humidity, and course conditions.
I attest that, if I am pregnant, disabled in any way, or have recently suffered an illness, injury, or impairment, I have consulted with a physician before participating in Event.
I consent to emergency medical care and transportation in the event of injury and to obtain treatment medical professionals may deem appropriate. This Release extends to any liability arising out of or in any way connected with medical treatment and transportation provided in the event of an emergency.
I agree and understand that I am expected to exhibit behavior that is appropriate at all times and to obey all laws. This includes, generally, respect for all people, equipment, and facilities. I may be removed from the Event, should my behavior endanger the safety or negatively affect the walk, person, the venue, myself or property of any kind.
I agree that the Event is not responsible for any personal item(s) or property that is lost or stolen at the Event. I understand that bicycles, skateboards, roller skates or roller blades are not allowed in the walk.
I accept personal responsibility for any and all actions of the Pet and agree that the Pet will be in my care, custody, and control during the Event. I hereby represent and confirm that the Pet is in good health and current on all vaccinations including rabies, DHLP, Parvo, and Bordatella, etc. and that the Pet is not the subject of a quarantine order, a pending adjudication or administrative hearing, and has never been declared a dangerous, potentially dangerous or vicious or potentially vicious pet.
I agree to be bound by the terms of the rules and regulations established by the Event. I will abide by all applicable governmental laws, ordinances, orders, directions, rules, and regulations, as well as all rules and regulations that are adopted for this Event. I acknowledge that the Event reserves the right to exclude or eject any and all unruly, rowdy, or disruptive participant, pet owner or Pet from the Event and that I shall be fully responsible for any damages or expenses, direct or indirect, incurred as a result of myself or my Pet’s disruptive behavior and/or ejection. I further agree that any Event official may authorize necessary treatment for me and/or the Pet in the event of injury.
I understand that the Event reserves the right to cancel or modify the Event if conditions create an unsafe Event, such as but not limited to accidents, labor disputes, acts of war or terrorism, military or armed conflicts, insurrections, rebellions, riots, explosions, lightening, earthquakes, fires, storms, terror attacks, rain, floods or wind.
Having read this waiver and knowing these facts and in consideration of your accepting my entry, I, for myself and anyone entitled to act on my behalf, waive and release Meals on Wheels of Mercer County, Event sponsors and organizers, and their partners, shareholders, representatives, agents, affiliates, employees and successors (the “Administrators”) from all claims and/or liabilities of any kind arising out of my participation in the Event even though such liability may arise out of negligence or carelessness on the part of the persons named in this waiver.
I understand that stroller use is permitted at the walk and I assume all liability related to its use.
I also grant permission to all the foregoing to use any photograph, motion picture, recordings, or any other record of the Event for any legitimate purpose.
I, the parent or guardian of the above-named participant, have read through this waiver and all its terms, and I hereby give my approval to this child's participation in the Walk. I assume all risks and hazards incidental to my child's participation in the Walk, and I hereby waive, release, absolve, indemnify and agree to hold harmless the Administrators, as defined above, for any injury to my child and from any and all claims, causes of actions, obligations, lawsuits, charges, complaints, controversies, covenants, agreements, promises, damages, costs, expenses, responsibilities, of whatsoever kind, nature or description, whether, direct or indirect, in law or in equity, in contract or in tort, or otherwise, whether known or unknown, from all claims or liabilities of any kind arising out of or connected with my child's participation in the Walk. I consent to the foregoing and grant permission for him/her to participate in the Walk.
I acknowledge I have carefully read, accepted, and agreed to the terms on this Assumption and Release and Liability waiver, and know and understand their contents and I sign the same on my own free act and deed.
When registering online, my online signature shall substitute for and have the same legal effect as an original form signature. I agree and understand that my PARTICIPATION WILL BE DENIED if the signature of an adult participant or parent/guardian and date are not signed at the time and place of the race.
